    • State trademark: A state trademark registration is issued by your state’s trademark office and protects your mark inside that state only. It’s ideal if you operate locally and use your mark within one state. A state registration doesn’t provide nationwide rights and doesn’t allow the ® symbol, use TM/SM unless and until you obtain a federal registration. The State Trademark approval is typically faster and more affordable.

    • USPTO trademark: Protects your brand nationwide but is more expensive and can take months to process.
      Most businesses start with a state trademark and expand federally as they grow.

    • Faster approval (often processed in weeks, not months.)

    • Lower cost (no $1,000+ upfront fees)

    • Provides a strong foundation for future USPTO registration

    • Starter: 1 mark, 1 class (per state) plus applicable state fee.

    • Standard: 1 mark, 2 classes (per state) plus applicable state fee.

    • Premium: 1 mark, 3 classes (per state) plus applicable state fee.
      Standard and Premium packages include support and a dedicated project manager to guide you through the process when you select the Premium package.

  • No. Each trademark package applies to one state only. If you plan to register your trademark in multiple states, you will need to purchase additional packages.

  • Trademark classes are categories of goods or services. For example, clothing is one class, while food products are another. Choosing the right class ensures your brand is protected in your industry.

  • State trademark approvals are typically much faster than USPTO filings, often processed in weeks. Exact timelines vary by state and how soon you provide the notarized legal applications.

  • Each state charges a separate government filing fee, which varies (usually between $30-$150 per class). DancaPath will charge the government filing fees once the notarized legal documents are returned to us.

  • Yes! You can always upgrade to protect additional classes or move toward a USPTO federal trademark once your brand expands.
