    At DancaPath, we stand behind the quality of our services. Our goal is to provide accurate, efficient, and affordable trademark registration support for entrepreneurs and small businesses at the state level. While our services and government filing fees are non-refundable, we offer the following Guarantee to protect our clients.

    • We guarantee the accuracy of preparation and filing of your state trademark application based on the information you provide.

    • If DancaPath makes an error in preparing or submitting your application, we will correct the error and refile at no additional service cost.

    • If the government rejects your application solely due to a DancaPath error, we will refile your application at no extra service fee.

  • Our Guarantee does not apply in the following situations:

    Errors or Omissions by the User

    • If the information you provide is inaccurate, incomplete, or misleading (e.g., wrong applicant name, incorrect class selection, inaccurate descriptions).

    • If you fail to provide the required documentation or specimens in a timely manner.

    • If you provide conflicting, unclear, or fraudulent information.

    Reasons Related to the Mark Itself

    Your application may be refused if the mark itself does not meet legal requirements. These outcomes are outside DancaPath’s control and are not covered under this Guarantee:

    • Likelihood of Confusion: The proposed mark is too similar to a registered or pending mark for related goods or services, which could create public confusion.

    • Merely Descriptive or Generic: The mark directly describes a feature, quality, or characteristic of the goods/services, or it is a generic term.

    • Fails to Function as a Trademark: The proposed mark is a common phrase, slogan, or design element that consumers would not associate with a single business.

    • Primarily a Surname: The mark consists mainly of a surname and does not distinguish the goods or services.

    • Primarily Geographically Descriptive: The mark implies an origin that does not match the true geographic source of the goods or services.

    • Misleading or deceptive marks: The mark is likely to mislead the public about the nature, quality, or origin of the goods/services.

    • Name without consent: The mark includes the name, portrait, or signature of a living person, or of a U.S. President (current or past), without written consent.

    Reasons Related to the Application Process

    Even if your mark is strong, applications can fail if the process itself has issues. These are not covered by the Guarantee:

    • Insufficient or Incorrect Information: Errors such as wrong owner name, flawed descriptions, or improper drawings.

    • Unacceptable Specimen: The proof of use provided does not meet state requirements, is low quality, or does not match the mark as described.

    • Failure to Use in Commerce: The mark has not been lawfully used in commerce, which is required for registration.

    • Incorrect Entity Named as Owner: The business name or entity type is incorrect or inconsistent with state requirements.

    • Procedural or Application Errors: Such as failure to disclaim descriptive terms when required, or other technical errors in the filing process

    • DancaPath’s service fees and state filing fees are non-refundable.

    • Our Guarantee is limited to correcting or re-filing your application at no additional DancaPath service cost when the error is ours.

    • If an application needs to be refiled due to an error on your part, you must purchase a new package.

    • Our Guarantee is limited to the amount you paid to DancaPath for the service.

    • DancaPath is not responsible for indirect damages, business losses, or third-party claims arising from your trademark application.
